PRIVACY POLICY

Young Artists of America, Inc. is an award-winning nonprofit organization that provides performing arts training programs and opportunities to high school and middle school level performing artists, in collaboration with leading professional artists. Our unique program is guided by the motto “Artistry. Excellence. Mentorship.”  

To help us achieve our goals, we need to collect certain information from you and your child, who may be under the age of 13, through our website, https://www.youngartistsamerica.org/ (collectively, with our mobile app referred to as the “Site”). Please see our Direct Notice to Parents re COPPA, which explains the requirements and mechanism for obtaining parental consent for the collection of personal information from children under 13 years of age. 

This Privacy Policy describes the types of information we collect, what we do with it, with whom we share it, and how you can correct or change such information. It represents an agreement between Young Artists of America, Inc. (also referred to as “YAA” or “we”) and you, the end user (referred to herein as “you” or the “user”) as to how the user’s personal information is being used by YAA.  

Please read our Privacy Policy and Terms of Use carefully. If you do not agree to be bound by this Privacy Policy and our Terms of Use, please immediately discontinue your use of the Site.

Please know that we may amend this Privacy Policy and the Terms of Use at any time and from time to time by posting such modifications on the Site. Except as required by law, we shall have no obligation to notify you of such changes other than posting such modifications on the Site. You can determine when this Privacy Policy was last revised by referring to the “Last Updated” legend at the bottom of this page.

This Privacy Policy applies only to information collected through the Site, but not to information collected or obtained from other sources. See Third-party links below. 


What kind of information does the Site collect?

Personal Information:  Personally Identifiable Information (“PII”), as described in U.S. privacy law, is information that can be used on its own or with other information to identify, contact, or locate a single person, or to identify an individual in context.  See How do we use the PII we collect? below.

Aggregate and Anonymous Data:  Aggregate and anonymous data is information collected automatically through the operation of the Site, as well as certain information about website usage which is aggregated and used in a manner that does not identify you personally (collectively, “Non-Identifying Data”). The Site may collect usage data (such as which pages of the Site you visit and in what sequence) through the use of various technologies. For example, we may collect IP addresses from individuals who access the Site. The Site does not link IP addresses to any PII, so although your session may be logged, you will remain anonymous to us. 

When do we collect PII?

We collect PII from you when you register for and participate in any of our programs, including our auditions and school year and summer programs, set up and manage an account, contact us for information, ask to be put on our email list, donate to YAA, purchase tickets and merchandise or otherwise enter information through the Site. 

Note re: virtual classes: By registering for a virtual class, you are agreeing that YAA may record the virtual sessions for archival and YAA promotional use. 

What PII do we collect from you or your child?

We do not collect more information that is reasonably necessary to participate in the YAA activity.  We collect the following PII via the Site:

  • When registering for a free YAA virtual class: name and email address (see note below re: recording of virtual classes.)

  • When setting up an account with YAA through our third-party registration vendors Acceptd and Active: name, email address, user name and password

  • When registering for an audition through our third-party registration vendors Acceptd and Active: name, email address, telephone number, school, address, age, gender and experience relevant to our productions

  • When participating in a virtual or in-person class: submission of assignments as applicable

  • When you contact us for information or ask to be added to our mailing list:  your name and email address

  • When purchasing tickets or making a donation: credit card information that is collected by GiveButter or Little Green Light, our third-party credit card processors.

  • When purchasing merchandise: credit card and mailing information that is collected by Shopify, our third-party merchandise fulfillment and payment processing vendor

  • When signing up for any of our school year or summer programs through our third-party registration vendors Acceptd and Active, more extensive PII than that obtained when registering for an audition is required in order to assure the health and safety of your child. Some of this information is known as Sensitive PII (information that if lost, compromised, or disclosed could result in substantial harm, embarrassment, inconvenience, or unfairness to an individual). In order to protect the health and safety of your child, we will need information such as health records, allergies, vaccination records and the like.  This information is provided to Acceptd and Active via a separate registration form that also includes waivers and releases, including permissions for use of your child’s image and voice, for parental signature.

How do we use the PII we collect?

We may use the PII we collect in the following ways:

  • To allow us to deliver our content and product offerings

  • To personalize your experience and improve the Site

  • To allow us to better respond to requests.

  • To administer a survey or other Site feature.

  • To quickly process our transactions.

  • To send periodic emails regarding our products and services.

  • To follow up with you after correspondence (email or phone inquiries) 

We may also use PII in aggregate form for purposes of research or analysis and for administration and promotional purposes.

 

What third parties do we share your information with?

PII:  Except as stated in this Privacy Policy, we do not disclose your PII to third parties without first informing you and obtaining your consent to having your PII shared.  As explained above (see What PII do we collect from you or your child?), we will obtain your specific consent to use of videos of your child’s performances on the Site as applicable in connection with the specific YAA activity.  We do not sell your PII for marketing or any other purpose, and we do not exchange mailing lists with other organizations.

We may disclose your PII to third parties without informing you in connection with the following:

  • Business-related functions: Like many organizations, we may hire other companies to perform certain services on our behalf such as hosting specific portions of the Site or maintaining databases. When we employ a third party to perform these functions, that third party will be provided only with the particular PII it needs to perform its function, and it will be required to keep the information confidential.  

  • Other disclosures: In addition, we may disclose PII without providing you with the ability to opt out under the following limited circumstances:

(1) to protect our legal rights, privacy or safety;

(2) to protect the safety and security of other users of the Site;

(3) to protect against fraud or other illegal activity or for risk management purposes;

(4) to respond to inquiries or requests from public authorities;

(5) to permit us to pursue available remedies or limit the damages that we may sustain;

(6) to enforce the Terms of Use and this Privacy Policy; or

(7) to comply with the law or legal process.

The third-party vendors we use to maintain the Site and collect and process PII, all of whom are required to keep the PII confidential, are the following:

Non-Identifying Data:  Non-Identifying Data may be provided to third parties for research or analysis. 

 

How do we protect your information?

We take reasonable security precautions to secure the PII that you choose to provide against the loss, misuse, alteration or unauthorized access of such information. Unfortunately, no transmission of data over the Internet is guaranteed to be completely secure. It may be possible for third parties, not under our control, to intercept or access transmissions or private communications unlawfully. While we strive to protect your PII, we cannot ensure or warrant the security of any PII you transmit to us. Any such transmission is done at your own risk. If you believe that your interaction with the Site is no longer secure, please notify us of the problem by contacting us using the Contact Us feature of the Site or by emailing us at privacy@yaa.org.

If we learn of a security systems breach, then we may attempt to notify you electronically so that you can take appropriate protective steps. We may post a notice on the Site if a security breach occurs. Depending on where you live, you may have a legal right to receive notice of a security breach in writing.

 

Use of cookies and similar technologies:  Like many providers of Internet services, we may use “cookies” or other similar technologies to collect Non-Identifying Data. For instance, we use cookies to help us remember and process your billing information. They are also used to help us understand your preferences based on previous or current Site activity, which enables us to provide you with improved services. We also use cookies to help us compile aggregate data about Site traffic and Site interaction so that we can offer better Site experiences and tools in the future. We may also use trusted third-party services that track this information on our behalf. 

Although our cookies do not contain any PII, you should be aware that PII that we store may be linked by us to the information obtained by cookies. We do not, however, link IP addresses to any personal information. You can choose to have your computer warn you each time a cookie is being sent, or you can choose to turn off all cookies. You do this through your browser settings. Since each browser is a little different, look at your browser’s Help Menu to learn the correct way to modify your cookies. Please be aware that if you turn cookies off, some of the features that make your Site experience more efficient may not function properly.

During some visits, the Site may use software tools, such as JavaScript and/or Google Analytics, to measure and collect session information, including page response times, download errors, time spent on certain pages, page interaction information, and methods used to browse away from the page.  These analytics features do not collect PII. 

In addition, we may use a service that collects data remotely by using so-called “pixel tags,” “web beacons,” “clear GIFs” or similar means (collectively, “Pixel Tags”) embedded in website content. A Pixel Tag is an electronic image, often a single pixel (1×1), that is ordinarily not visible to site visitors and may be associated with cookies on the visitors’ hard drives. This information is Non-Identifying Data.


Children’s Privacy Policy

When it comes to the collection of personal information from children under the age of 13 years old, the Children’s Online Privacy Protection Act (COPPA) puts parents in control. The Federal Trade Commission, the U.S. consumer protection agency, enforces the COPPA Rule, which spells out what operators of websites and online services must do to protect children’s privacy and safety online. In accordance with COPPA, we require prior parental consent before collecting any PII from children under 13.  Please see our Direct Notice to Parents re COPPA.

 

Your choices and individual rights

All users of the Site may update or modify the PII previously submitted to us at any time by emailing us at privacy@yaa.org, by calling us or by logging into your account (through the Manage My Account feature).  If you ask that we stop using your PII, we will take reasonable steps to honor that request on a prospective basis. However, we may retain records of your PII for analytical purposes, record-keeping integrity, to prevent fraud, enforce our Terms of Use, or as needed in order to comply with applicable federal, state, or local law. In addition, if certain PII has already been provided to third parties as described in this Privacy Policy, we will take reasonable steps to ensure that the data is also deleted by such third parties.  

Although we do not knowingly request PII from residents of the European Union, if you reside in the European Union, you may have additional rights of privacy, including the right of access, the right of rectification, the right not to consent or to withdraw consent, the right of erasure, the right to object to processing, and the right to restrict processing.  See more at:  https://www.gdprsummary.com/gdpr-summary/

Occasionally, at our discretion, we may include on our website links to sites offering third-party products or services. These third-party sites have separate and independent privacy policies. We therefore have no responsibility or liability for the content and activities of these linked sites. Nonetheless, we seek to protect the integrity of our site and welcome any feedback about these sites.

  

How does our site handle Do Not Track signals?

We honor Do Not Track signals and Do Not Track, plant cookies, or use advertising when a Do Not Track (DNT) browser mechanism is in place.
